This Privacy Policy describes the policies of BottleApp Messenger SL, located at Avenida del Golf 56, Altorreal, Molina de Segura, Murcia, 30506, Spain, email: info@bottleappmessenger.app, regarding the collection , the use and disclosure of your information that we collect when you use our application (BottleApp Messenger) (the “Service”). By accessing or using the Service, you consent to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.

 

We may modify this Privacy Policy at any time without notice and will post the revised Privacy Policy on the Service. The revised Policy will be effective 180 days after it is posted on the Service and your continued access or use of the Service after that time will constitute your acceptance of the revised Privacy Policy. Therefore, we recommend that you periodically review this page.

 

Information we collect

We will not transfer your personal information to any third party without seeking your consent, except in limited circumstances as described below:

Location Services Runtime Permissions

Always / Allowed all the time:

If you grant this permission, we may collect your precise geolocation data (latitude and longitude) in the form of background location. This permission will be used exclusively for the functionality of BottleApp Messenger. The use of your background location data is necessary to enable BottleApp Messenger to send location specific notifications such as when a GPS Bottle is within range and can be opened, both when the application is open and active on your device, and when the app is closed and not in use. To experience the full benefits of BottleApp Messenger, the location services settings on your device, specific to the BottleApp Messenger application, need to be set to Always / Allowed all the time.

 

While Using / Allowed only while in use:

If you grant this permission, we may collect your precise geolocation data (latitude and longitude) in the form of foreground location. This permission will be used exclusively for the functionality of BottleApp Messenger. The use of your foreground location data is necessary to enable BottleApp Messenger to send location specific notifications such as when a GPS Bottle is within range and can be opened, but this permission will only allow this service to function while the application is open and in use on your device. With this permission, the key features of the BottleApp Messenger location-based messaging service will be unable to function when the app is closed or not in use. To experience the full benefits of BottleApp Messenger, the location services settings on your device, specific to the BottleApp Messenger application, need to be set to Always / Allowed all the time.

 

Never / Not allowed:
This is the default setting when the BottleApp Messenger application is downloaded to your device. The Never / Not allowed setting will deny us permission to access your precise geolocation. Without your permission, the key features of the BottleApp Messenger location-based messaging service will be unable to function, both when the app is open and in use on your device, and when the app is closed or not in use.  To experience the full benefits of BottleApp Messenger, the location services settings on your device, specific to the BottleApp Messenger application, need to be set to Always / Allowed all the time.

 

This data is also used to provide ads.

Retention of your information

We will keep your personal information with us for 90 days to 2 years after users close their accounts or for as long as we need to fulfil the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods, such as record keeping/reporting in accordance with applicable law or other legitimate reasons such as enforcement of legal rights, fraud prevention, etc. Anonymous residual information and aggregate information, which does not identify you (directly or indirectly), may be stored indefinitely.

 

Your rights:

Depending on applicable law, you may have the right to access and rectify or erase your personal data, or receive a copy of your personal data, restrict or object to active processing of your data, ask us to share (transfer) your personal data to another entity, withdraw any consent you have provided to us to process your data, right to lodge a complaint with a competent authority and other relevant rights under applicable laws. To exercise these rights, you can write to us at info@bottleappmessenger.app. We will respond to your request in accordance with applicable law.

Please note that if you do not allow us to collect or process the requested personal information, or withdraw your consent to process it for the required purposes, you may not be able to access or use the services for which your information was requested.

 

Security

The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and, consequently, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

User-Generated Content

The application includes a moderation mechanism designed to ensure that user-generated content complies with our policies. This system allows:

  • Blocking users and content: Users have the option to block content from other users that they deem inappropriate. Additionally, if a user violates our rules, they may be blocked, preventing them from posting or receiving content on the application.

  • Content review and moderation: Reported content will be reviewed by our moderation team, which can take the necessary steps to moderate or remove such content.

  • Content management options: Blocked users will have the option to delete their content directly from the application, ensuring greater control over the information they share.

This mechanism helps maintain a safe and respectful environment for all users of the platform.
 

 

Third Party Links and Use of Your Information

Our Service may contain links to other websites that are not operated by us. This Privacy Policy does not address the privacy policy and other practices of any third parties, including any third party that operates any website or service accessible through a link on the Service. We strongly recommend that you review the privacy policy of each site you visit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party sites or services.

Premium content and payment method
BottleApp Messenger offers you the ability to pay for premium services. BottleApp Messenger premium services allow you to access GPS Bottle content without ads and create GPS Bottle chains with no length limit.
You can purchase this premium service after registering, and it is possible to contract the service through an auto-renewable annual subscription.
If you purchase an auto-renewing subscription through an in-app purchase, your selected payment method will be billed for the subscription until canceled. After the initial commitment period for the subscription – and after any subsequent subscription period – the subscription will automatically continue for an additional period equivalent to the price you agreed to when subscribing. Your card payment details will be stored and subsequently used to make automatic payments as stipulated in the terms.
The payment method for purchases will be selected during the purchase process and payment, according to the chosen method, will be made at the end of the purchase process and will be an essential condition for its formalization.
Payment will be made through the stores offered by your operating system, such as the App Store or Google Play.
Once you purchase a premium service, you authorize BottleApp Messenger to charge you through your chosen payment method. If you want to cancel or change the payment method, you will have to do it from the store offered by your system.
Objections to payments already made should be directed to customer service if you were billed directly by BottleApp Messenger or the applicable third-party account (such as the App Store). You can also raise objections with your bank or payment provider, who will be able to provide you with more information about your rights and applicable deadlines. You may unconditionally withdraw your consent to automatic card payments at any time in the settings of BottleApp Messenger or the applicable third-party account. However, please note that you will still be obligated to pay any outstanding amounts.
If you want to change or cancel your subscription, you will need to log in to your third-party account (or check your information under "My Account" > "Notifications" > "Go Premium" in BottleApp Messenger, if applicable) and follow the instructions to cancel your subscription, even if you have already deleted your account or the BottleApp Messenger application from your device. To delete the account on BottleApp Messenger, you can do so through “My Account”>”My Data”>”Delete Account”. Deleting your BottleApp Messenger account or the app from your device does not mean cancellation of subscription. In that case, BottleApp Messenger will hold all funds charged to your payment method until you cancel the subscription through BottleApp Messenger or the third-party account, as the case may be. If you cancel your subscription, you may continue to use your subscription until the end of the current subscription period. After the end of the current subscription period, the subscription will not be renewed.
If you purchase premium subscriptions, you have the right to cancel and obtain a refund for all payments made, if the cancellation occurs within the first 14 days. If you have enjoyed any of the premium services, it will be deducted from your refund. If you wish to cancel them, please contact us using the contact details.
If you purchase the subscription, at the time of purchase you will be waiving the right of withdrawal, since the digital content will be at your full disposal from the moment you purchase it.
If you made a purchase using your Apple ID, refunds are handled by Apple. To request a refund, go to the App Store, click on your Apple ID, select “Purchase History,” find the transaction, and tap “Report a Problem.” You can also submit a request through  Apple Support. If you made a purchase through your Google Play Store account, please contact customer service with your Google Play Store order number (found in your order confirmation email and Google Wallet ).
